1. Service Description

FertiFlirt is a web-based fertility tracking application that helps users track their menstrual cycle, calculate their fertile window, and optionally send automated SMS notifications — called "Flirt Alerts" — to a designated partner's phone number during their fertile window.

FertiFlirt is operated by Polsia Inc. and can be reached at gotime@polsia.app.

2. Eligibility

You must be at least 18 years old to use FertiFlirt. By using the service, you confirm that you are 18 or older and are legally capable of entering into a binding agreement.

3. Account Registration

You must create an account with a valid email address to use FertiFlirt. You are responsible for:

• Keeping your password confidential.
• All activity that occurs under your account.
• Notifying us immediately at gotime@polsia.app if you suspect unauthorized access.

You may not share your account or create accounts on behalf of others without their consent.

4. Acceptable Use

You agree not to:

• Use FertiFlirt for any unlawful purpose or in violation of any regulations.
• Enter phone numbers belonging to individuals who have not consented to receive SMS messages.
• Attempt to reverse engineer, hack, or disrupt the service.
• Use the service to harass, spam, or send unsolicited messages to any person.
• Impersonate any person or entity or provide false information.
• Use automated tools (bots, scrapers) to access the service.

We reserve the right to suspend or terminate accounts that violate these rules.

5. SMS Consent & Opt-Out Instructions

FertiFlirt sends automated SMS messages from +1 (844) 482-8458 via Twilio. By entering a partner phone number and enabling SMS notifications, you represent and warrant that:

• You have obtained prior express written consent from the phone number owner to receive automated SMS messages from FertiFlirt.
• The recipient is 18 years of age or older.

How to Opt Out

• The recipient can reply STOP to any message to unsubscribe immediately.
• You can remove the partner phone number from your FertiFlirt dashboard at any time to stop all future messages.
• Reply HELP to any message for assistance.

6. Payment Terms & Subscription

Free Tier

FertiFlirt's core features — cycle tracking, fertile window calculation, and dashboard — are free to use with no credit card required.

Premium Plan

Daily automated SMS notifications to your partner require an active Premium subscription at $9.99/month. Payments are processed by Stripe Inc.

Billing

• Your subscription renews automatically on the same date each month.
• You will be charged on each renewal date unless you cancel before it.
• All charges are non-refundable except as required by applicable law.

Cancellation

• You may cancel your subscription at any time from your account settings or by contacting us at gotime@polsia.app.
• Cancellation stops future charges. You retain access to Premium features through the end of the current billing period.

Price Changes

We may change subscription pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new price.

7. Intellectual Property

All content, design, code, and materials on FertiFlirt are owned by or licensed to Polsia Inc. You may not reproduce, distribute, or create derivative works without our written permission.

You retain ownership of the personal data you enter into FertiFlirt. By using the service, you grant us a limited license to process your data as described in our Privacy Policy.

8. Disclaimers

FertiFlirt is an informational aid — not a contraceptive or medical device. Do not rely on FertiFlirt as your sole method of family planning.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Polsia Inc. and its affiliates, officers, employees, and agents shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of data, revenue, profits, or goodwill.
• Damages arising from your reliance on fertility predictions provided by FertiFlirt.
• Damages caused by SMS delivery failures, delays, or errors.

Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Polsia Inc. from any claims, damages, or expenses (including legal fees) arising from: (a) your violation of these Terms; (b) your use of the service; or (c) your violation of any third party's rights, including the rights of any SMS recipient.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts of Delaware.

12. Changes to These Terms

We may update these Terms from time to time. We'll notify you of material changes by email or by posting a notice on the site. Continued use of FertiFlirt after changes take effect means you accept the updated Terms.

13. Termination

We may suspend or terminate your account at any time if you violate these Terms. You may delete your account at any time. Sections 7, 8, 9, 10, and 11 survive termination.
